I'd be very surprised if either of those two charges stand up in court. In the first place, he did NOT capture an image of an unclothed person. The girl obviously had clothes on, including underwear. So I don't know what he stood to gain from that anyway. Also, he used his PHONE to take the pictures, and he was arrested while still in the mall. He did NOT have time to go home to his computer to do anything with the pictures. Any good attorney could easily get both charges dropped. I'm not defending the guy or his actions, but that's the way I interpret the situation.
