Not bothering to wear a top while out of doors does not create a “reasonable expectation of privacy”. In order to have the legal right to privacy you must first take a reasonable precaution to ensure your privacy. At that point someone else must make a meaningful effort to overcome your precaution. That is why they call it “invasion of privacy”.
